These Terms and Conditions ("Terms") govern your use of the website medper.in and your purchase of MedpeR® products from Inovocare Healthsoft Solutions Pvt. Ltd. ("we", "us", "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.
1. About us
Inovocare Healthsoft Solutions Pvt. Ltd. is a company incorporated under the Companies Act, 2013, with its principal place of business at 377, Purbalok, Mukundapur, Kolkata – 700099, West Bengal, India. We manufacture and sell MedpeR®, a smart medication adherence device listed under the Central Drugs Standard Control Organisation (CDSCO) as a Class A NSNM medical device.
2. Use of this website
You may use this Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable Indian or international law.
- Attempt to gain unauthorised access to any part of the Site or its infrastructure.
- Transmit any material that is defamatory, offensive, or otherwise objectionable.
- Use automated tools to scrape, copy, or extract content from the Site without our written consent.
- Reproduce, republish, or redistribute any content from this Site without our prior written permission.
We reserve the right to terminate or restrict your access to the Site at our discretion, without notice, if we believe you are in breach of these Terms.
3. Product information and medical disclaimer
We make reasonable efforts to ensure that product descriptions, specifications, and information on this Site are accurate and up to date. However, we do not warrant that all information is error-free, complete, or current.
MedpeR® is a medication adherence support device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The device assists in scheduling reminders and detecting whether a compartment has been opened; it does not verify what was inside the compartment or whether the correct medication was consumed.
Always configure MedpeR® under the supervision of a qualified healthcare professional. We strongly recommend that medication schedules be set up in consultation with the treating physician.
4. Ordering and purchase
4.1 How to order
Retail purchases of MedpeR® can be made directly through our online checkout, or via WhatsApp. By initiating a purchase via the "Order via WhatsApp" button on this Site, you agree to communicate your order details — including your name, delivery address, and the quantity required — directly to our team via WhatsApp.
An order is confirmed only when we send you an explicit confirmation message via WhatsApp, SMS, or email. We reserve the right to decline any order at our discretion.
4.2 Pricing
The price displayed on the Site at the time of your order is the price applicable to your purchase. All prices are in Indian Rupees (INR) and are inclusive of applicable GST unless otherwise stated. We reserve the right to change prices at any time without prior notice, but price changes will not affect orders that have already been confirmed.
4.3 Payment
Orders placed through our online checkout are processed securely by Razorpay and accept UPI, credit/debit cards, and netbanking. We do not collect, store, or process card numbers, bank account credentials, or any other financial data — all payment processing is handled directly by Razorpay and your bank or payment provider.
Orders placed via WhatsApp are paid by UPI (Unified Payments Interface): after you send your order details, our team will share a UPI QR code or UPI ID for payment, which must be completed and a screenshot shared with us before the order is dispatched.
We are not responsible for any errors, delays, or failures in payment processing by Razorpay, your UPI application, or your bank.
4.4 Institutional purchases
Institutional purchases (for hospitals, nursing homes, care facilities, or other organisations) are handled separately through our institutional enquiry process. Institutional pricing, payment terms, and deployment terms are agreed upon in writing between the parties prior to any order confirmation.
5. Delivery
We currently ship MedpeR® within India only. Delivery timelines are indicative and depend on your location and the availability of courier services. We will inform you of the expected delivery timeline when confirming your order.
We are not liable for delays caused by courier services, natural events, or circumstances beyond our reasonable control. Risk of loss or damage passes to you upon delivery to the courier.
If your order is damaged in transit, please photograph the damage and notify us at care@medper.in within 48 hours of delivery.
6. Returns, replacements, and warranty
6.1 Warranty
MedpeR® carries a 1-year manufacturer's warranty from the date of delivery. This warranty covers defects in materials and workmanship under normal use. It does not cover damage caused by misuse, modification, unauthorised repair, or physical damage.
6.2 Replacement process
If your device develops a manufacturing defect within the warranty period, contact us at care@medper.in with a description of the issue and photographs where applicable. We will assess the claim and, if the defect is confirmed, arrange a replacement at no additional cost.
6.3 Returns
Given the nature of MedpeR® as a medical device, we accept returns only in the following circumstances:
- The device was delivered damaged or in a condition different from what was ordered.
- The device develops a confirmed manufacturing defect within 30 days of delivery and you prefer a refund over a replacement.
Returns must be initiated within 30 days of delivery by contacting us at care@medper.in. Items must be returned in their original packaging. Refunds, where applicable, will be processed to the original UPI account within 7–8 business days of our receiving the returned item.
We do not accept returns for change of mind once the device has been used.
7. Intellectual property
All content on this Site — including text, images, graphics, product names, logos, and the MedpeR® name and mark — is the property of Inovocare Healthsoft Solutions Pvt. Ltd. or its licensors and is protected by applicable Indian intellectual property law.
MedpeR® incorporates technology protected by patents granted in India. Unauthorised reproduction, reverse engineering, or imitation of the device or its underlying technology is prohibited.
You may not reproduce, republish, distribute, or create derivative works from any content on this Site without our prior written consent.
8. Limitation of liability
To the fullest extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, or consequential loss arising from your use of MedpeR® or this Site.
- We are not liable for any loss arising from your reliance on information on this Site without obtaining independent professional medical advice.
- Our total liability for any claim arising from the purchase of a MedpeR® device shall not exceed the price paid for that specific device.
- We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including but not limited to power failures, internet outages, or force majeure events.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
9. Indemnification
You agree to indemnify and hold harmless Inovocare Healthsoft Solutions Pvt. Ltd., along with its directors, officers, employees, and agents, from any claims, damages, or expenses — including reasonable legal fees. This applies to claims arising from: your breach of these Terms; your misuse of MedpeR® contrary to its intended purpose; or your violation of any applicable law.
10. Third-party services and links
This Site links to third-party services including WhatsApp (Meta Platforms), Formsubmit.co (for form submissions), and Plausible Analytics. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the content, availability, or practices of any third-party service.
11. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms or your use of the Site or purchase of MedpeR® products shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India.
We encourage you to contact us at care@medper.in in the first instance to resolve any dispute informally before initiating formal proceedings.
12. Consumer rights
If you are a consumer resident in India, nothing in these Terms affects your rights under the Consumer Protection Act, 2019, the Information Technology Act, 2000, or any other applicable consumer protection legislation. In the event of any conflict between these Terms and your statutory consumer rights, your statutory rights prevail.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Site or purchase of our products after changes are posted constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.
